Private workers on duty on Jan. 1 entitled to double pay – DOLE

PRIVATE sector workers, who reported to work on Jan. 1 or New Year’s Day, are entitled to double since the day is a regular holiday, the Department of Labor and Employment (DOLE) said.

This benefit is provided under Labor Advisory No. 13, series of 2019, issued by Labor secretary Silvestre Bello III for employers’ guidance on the proper payment of wages for the regular and special (non-working) days for the year 2020.

Specifically, private sector employees who are on duty on Jan. 1 will be paid 200 percent of their wages for the first eight hours (basic wage and Cost of Living Allowance or COLA) x 200 percent). Employees who will not work on this regular holiday will be paid 100 percent of their wages for that day (basic wage + COLA) x 100 percent).

Employees who will render overtime work, on the other hand, will be paid an additional 30 percent of their hourly rate on the said day. This is computed as follows: hourly rate of the basic wage multiplied by 200 percent multiplied by 130 percent and multiplied by the number of hours worked.

The DOLE said employees who will work on a regular holiday that also falls on their rest day will be paid an additional 30 percent of their basic wage of 200 percent.

Meanwhile, employees who will render overtime work on a regular holiday that also falls on their rest day will be paid an additional 30 percent of their hourly rate on the said day.

The Labor Advisory No. 13 which provides for double pay is also in accordance with Proclamation No. 845 signed by President Rodrigo Duterte last Nov. 15, 2019. (GMA News)
