ILOILO City – A resident of Barangay Duyan-Duyan, Santa Barbara, Iloilo could be penalized under a new and comprehensive law against car theft.
The 40-year-old Mario Encanto was charged with violation of Republic Act (RA) 10883, or the New Anti-Carnapping Act of 2016.
Municipal police served him a warrant of arrest around 10 a.m. on Monday and detained him at their station.
Regional Trial Court Judge Daniel Antonio Gerardo Amular issued the arrest warrant and set the bail at a hefty P300,000. It was not clear as of this writing whether or not the suspect has posted bail.
The New Anti-Carnapping Act of 2016 was one of the new measures that the Duterte administration allowed to lapse into law.
It repeals RA 6539, or The Anti-Carnapping Act of 1972, according to Sen. Grace Poe, sponsor of the measure in the chamber.
Under the new law, a person found guilty of car theft would be penalized with 20 to 30 years of jail term. The old law only imposes 14 years and eight months to 17 years and four months imprisonment.
“If violence, intimidation or use of force were used, the person found guilty would be imprisoned for 30 years and one day to 40 years,” Poe said.
“When the owner, driver, occupant of the carnapped motor vehicle was killed or raped, the person found guilty would be sentenced to life imprisonment,” she added./PN
