THE STATE GOVERNMENTS
The States will be divided into provinces, municipalities, and the latter into barrios. The State may convert an area into a city. The Federal Government shall be vested with the exclusive jurisdiction over the delimitation of boundaries of each State.
The Constitution of the State Government
Each state shall enact its own Constitution, subject to the limitations provided in this Constitution. However, the States shall start functioning even before their respective Constitutions have been enacted. The Federal Government can provide a Standard State Constitution to cover areas not specifically provided in the Bayanikasan Constitution.
The Pattern of the State Government
The organization of each State shall be similar to the Federal Government, with a Troika at the top, elected by the State Assembly in a manner similar to that of the Federal Government.
Composition of the Troika
The leadership in the Executive shall be vested in the Troika composed of the Governor General, the Premier and the Speaker of the State Assembly. Each leader will have their specific, separate and defined powers and duties.
The Governor General shall have jurisdiction over Departments, instead of Ministries, and he will be entrusted with interstate matters. He is thus in charge of the Department of Culture and Education and the Department of Peace and Order. The Premier shall have supervision over all other Departments which will be mainly concerned with the economic development of the State. The Speaker of the State Assemblies shall have the corresponding powers and duties of the Speaker of the Parliament.
The Election of Officials
The high officials on the local levels shall be elected by the people directly through a pyramidal system: the electors in a barrio will elect the barrio councilors who will, in turn, elect the barrio captain, who will serve as an ex-officio member of the provincial Council which shall elect amongst themselves the Municipal Mayor. The Mayor will be an ex-officio member of the Provincial Council and the members of which will elect themselves the Troika of the Province.
Succession Provisions
In case of death or incapacity of members of the Troika of the State Government, the ranking official under the jurisdiction of the incapacitated member shall take his place. An official in an acting capacity shall be replaced for the unexpired term by election of the members of the Legislative power.
The New Profile of the Public Servants
No person shall hold two government offices at the same time. This prohibition applies automatically to the spouse. While a person is in government service, he must give his full time and attention to the people.
No person who has served, in any capacity in any level of government during one administration is qualified to serve in a non-career officer in the next administration.
Non-career public servants are those elected or appointed and not belonging to the civil service, the judiciary, the police force and diplomatic service, except for a few ambassadors who may be political appointees. (To be continued/PN)
