DOE supports SC decision upholding takeover powers

THE Department of Energy (DOE) yesterday said it supports the Supreme Court’s decision to uphold its takeover powers over the oil industry in times of national emergencies.

The DOE said they will study fully the clarifications made by the Supreme Court, and take the necessary steps to ensure that this measure of last resort is properly exercised whenever needed.

The High Court on Tuesday, March 5, granted the petition of former Arroyo administration officials against Pilipinas Shell Petroleum Corporation.

The issue arose from the declaration of then President Gloria Macapagal-Arroyo of a state of calamity in 2009 after widespread devastation caused by Tropical Storm “Ondoy.”

Section 14(e) was the basis of the order of the President directing oil industry players to maintain the prices of their petroleum products.

Pilipinas Shell found the order prejudicial to oil companies and brought the matter to the lower courts.

The DOE also said it will continue to work to make energy available at affordable prices to all Filipinos.

It added: “The DOE will also continue to consult and work with all stakeholders on maximizing and diversifying sources of energy supply, enhancing its distribution and availability to the public at reasonable prices, managing the prioritization of demand to avoid or minimize potential constraints, and strengthening overall capacity to bounce back from interruptions.
