ILOILO City – The Employees’ Compensation Commission (ECC) has extended the filing period for seafarers’ claim for compensation for work-related illnesses or injuries.
In Circular No. 2024-01, issued by Executive Director Atty. Kaima Via B. Velasquez, the ECC has established a new starting point for the three-year prescriptive period for these claims.
“This circular is a crucial step in ensuring that our seafarers have adequate time to file their claims, given the unique challenges they face while at sea,” said ECC Regional Extension Unit 6 (REU 6) Representative Stephene Barredo.
Under the new guidelines, the three-year period to file an Employees’ Compensation (EC) claim will now commence from the date a seafarer disembarks, as recorded in their Seafarer’s Record Book. This change acknowledges the difficulties of maritime work, including limited internet access and logistical challenges that can impede timely claim submissions while at sea.
“Setting the reckoning date from disembarkation aims to provide seafarers with more time and support. It reflects our commitment to their health and rights, ensuring they can access the benefits they deserve without undue pressure,” said Barredo.
The circular also builds upon existing Board Resolutions regarding the evaluation of claims for Permanent Total Disability (PTD) and Temporary Total Disability (TTD), as outlined in previous regulations.
Barredo said the ECC hopes that this adjustment will streamline the claims process for seafarers, who are vital to the country’s economy.
He encouraged all stakeholders, particularly seafarers and their families, to familiarize themselves with the recent changes or new guidelines which will be implemented immediately.
“We urge everyone to take note of this important change and to seek assistance if they need help navigating the claims process,” added Barredo.
