MANILA – As the holidays are approaching, employers in the country have been reminded to pay their workers’ 13th month pay and year-end bonus.
The Labor Code mandates the payment of 13th month benefit on or before Dec. 24. The amount shall also be equivalent to 1/12 of the basic salary of an employee within a calendar year.
“Isa talaga ang 13th month pay sa pinakainaabangan ng ating mga ordinaryong manggagawa tuwing patapos ang taon,” said Sen. Juan Edgardo “Sonny” Angara.
“Tinaasan natin ang tax exemption cap para naman mas malaki ang maiuuwi nilang bonus para sa kanilang pamilya.”
Angara was referring to Republic Act 10653, which raised the ceiling for tax exemption on bonuses and other benefits. The cap was increased from P30,000 to P82,000.
According to the senator, all rank-and-file employees are also entitled to a 13th month pay regardless of the nature of their work and methods of wage payment.
They should, however, have completed at least one month’s work, he added.
“Hindi lamang po mga regular na empleyado sa pribadong sektor and dapat makakuha ng 13th month pay. Kahit ang mga contractual, casual, fixed term, probationary, seasonal employees may karapatan din makatanggap ayon sa ating Labor Code basta nakapagbigay ng serbisyo ng kahit isang buwan lamang,” the vice chairman of the Senate Committee on Labor said.
Angara also stressed that domestic workers, under Republic Act 10361, or the Batas Kasambahay, should also be given 13th month pay./PN
