Indigenous Peoples Rights Act (IPRA) of 1997

Chapter III, Section 7 – The right to ancestral domain, the right of ownership and possession, of ICCs/IPs

  1. right of ownership
  2. right to develop land and natural resources
  3. right to stay in the territories
  4. right to resettle and return in case of displacement
  5. right to regulate entry of migrants
  6. right to safe and clean air and water
  7. right to claim parts of reservations
  8. right to resolve conflicts

1987 Constitutional Provision – Article XVI, Section 11– Ownership and management of mass media shall be limited to citizens of the Philippines, or to corporations, cooperatives or associations, wholly owned by such citizens.

Article II Sec. 26 – Prohibition on Political Dynasties

Article XII – National Economy and Patrimony – Section 1 – The goals of the national economy are a more equitable distribution of opportunities, income, and wealth; a sustained increase in the amount of goods and services produced by the nation for the benefit of the people; and an expanding productivity as the key to raising the quality of life for all and especially the underprivileged. The State shall promote industrialization and full employment based on sound agricultural development and agrarian reform to industries that make full and efficient use of human and natural resources, and which are competitive in both domestic and foreign market. However, the State shall protect Filipino enterprises against unfair foreign competition and trade practices.

In the pursuit of these goals, all sectors of the economy and all regions of the country shall be given optimum opportunity to develop. Private enterprise including corporations, cooperatives, and similar collective organizations, shall be encouraged to broaden the base of their ownership. (Editor’s Note: This broad based ownership is one of the tenets of the Bayanikasan Constitution to achieve capitalism for all.)

Article XIII, Section 9 – Urban land reform and housing – The State, shall by law and for the common good undertake, in cooperation with the private sector, a continuing program of urban land reform and housing.

Article XIII – Social Justice and Human Rights, Section 8 – The State shall provide incentives to landowners to invest the proceeds of agrarian reform program to promote industrialization, employment creation, and privatization of public sector enterprises.

Article II, Section 9 – State Polices – The State shall promote a just and dynamic social order that will ensure the prosperity and independence of the nation and free the people from poverty through policies that provide adequate social services, promote full employment, a rising standard of living and an improved quality of life for all.

Article VII – Executive Department, Section 13 – The President, Vice President, the members of the cabinet, and their deputies or assistants, shall not, unless otherwise provided in the Constitution, hold any other office or employment during their tenure. They shall not, during said tenure, directly or indirectly practice any other profession, participate in any business, or be financially interested in any contract with or in any franchise, or special privilege granted by the government or any subdivision, agency or instrumentality thereof.
