MANILA – The Court of Appeals (CA) has affirmed the guilty verdict against US Marine Lance Corporal Joseph Scott Pemberton for the murder of transgender Filipina Jennifer Laude.

In a decision released by the CA Special 16th Division on Monday, the appellate court has junked the petition of Pemberton to reverse his homicide conviction from the Olongapo City Regional Trial Court.

The special appellate court has also tasked Pemberton to pay the heirs of Laude P4.32 million for loss of earning capacity, P30,000 for exemplary damages and P155,250 for actual damages.

The American soldier is currently detained at a restricted facility at the Armed Forces of the Philippines (AFP) headquarters in Camp Aguinaldo in Quezon City.

On December 2015, the Olongapo local court convicted Pemberton for six to 12 years for the death of Laude. The American soldier was also asked to pay the victim’s family at least P4.5 million for damages.

Pemberton was implicated in the killing of Laude in Oct.11, 2014. Philippine National Police medico-legal report noted that Laude died due to strangulation and asphyxia by drowning.

Pemberton admitted at the witness stand that he choked the 26-year-old Laude inside the Celzone Lodge in Olongapo City after he found out that she was transgender.

Pemberton was one of the US soldiers conducting a joint drill with Filipino forces under the Visiting Forces Agreement. The killing of Laude triggered public outrage and rekindled calls for the scrapping of the VFA./PN
