ILOILO City – A motorcycle driver hit a car in Barangay Peña, Buenavista, Guimaras. He died.
Noel Pabroaga of Barangay New Poblacion, Buenavista was not wearing a helmet, police said.
The vehicular accident happened on Tuesday around 10:30 a.m.
Pabroaga died of severe head and body injuries, said Senior Inspector Jefrey Ferrer, Buenavista police chief.
The car driver, Senior Inspector Henry Gaborno, sustained head injuries and was taken to the Iloilo Mission Hospital in Iloilo City.
Gaborno was the municipal police chief of San Lorenzo, Guimaras.
According to Ferrer, Pabroaga overtook a truck then tried to do the same to another motorcycle but lost control and hit Gaborno’s car that was running in the opposite direction.
“Pabroaga did not have a driver’s license, too. Witnesses said he was driving fast,” said Ferrer.
Republic Act (RA) 10054 or the Motorcycle Helmet Act of 2009 mandates all motorcycle riders to wear a standard helmet. This law was passed pursuant to the State’s objective of having a more proactive and preventive approach to secure the safety of motorists, their passengers and pedestrians at all times.
According to RA 10054: “All motorcycle riders, including drivers and back riders, shall at all times wear standard protective motorcycle helmets while driving, whether long or short drives, in any type of road and highway.”(Sec. 3, Id.)
RA 10054 also provides that any person caught riding a motorcycle without wearing the standard protective motorcycle helmet shall be punished with a fine of P1,500 for the first offense; P3,000 for the second offense; P5,000 for the third offense; and P10,000 plus confiscation of the driver’s license for the fourth and succeeding offenses.
