BACOLOD City – Silay City legal officer Janus Jarder welcomed the charges filed and will be filed against Mayor Mark Andrew Golez and the members of the city’s Disposal Committee.

Jarder said this after Atty. Archie Baribar, legal counsel of Franklyn Junkshop, said criminal and administrative cases against the city officials are being readied for filing before the Office of the Ombudsman.

Franklyn Junkshop sought from the Regional Trial Court (RTC) an injunction and damages against the city officials after it claimed that it was not awarded the contract for winning the bidding on city government-owned junk vehicles, waste materials and other items in October 2017.

In the civil case it filed before the RTC, Franklyn Junkshop named Golez, Disposal Committee members Atty. Ryan Montoro, Ramon Dumancas, Salvador Melgar, Elsie Jimenea, DeLa Ledesma, and Kent Torres, and Errol Mariah Enterprises authorized representative Raul Belleza as respondents.

According to Jarder, the charges that the junkshop filed have “no basis,” citing that the RTC has not issued any temporary restraining order preventing the city government to award the contract to Errol Mariah Enterprises, one of the bidders.

The case is still pending resolution at the RTC.

For his part, Montoro said Franklyn Junkshop was not the winner in the October 2017 bidding.

He said the junkshop do not have the“capacity to pay,” citing an evaluation that the Disposal Committee conducted.

Franklyn Junkshop only has P1.5 million but its bid was P3.7 million, said Montoro.

“How can they pay the city if their money is lower that their bidding amount?” he said.

But according to Baribar, the junkshop was financially qualified.

Franklyn Junkshop owner Analyn Posa submitted to the Bidding Committee a Certificate of Bank Deposit and/or Placement issued by Banco de Oro (SMA-379-17-126) dated Nov. 7, 2017, in the total amount of P5,531,429.27, Baribar said.

Montoro said they are ready to answer the charges. They followed the proper procedures, he stressed./PN
