ILOILO City – The owner of the lot in Barangay Don Esteban, Lapuz district where the Rockwell Lumber and Cockpit Arena stands denied authorizing the cockpit operator to use her property.
According to Atty. Rey Canindo, his client and lot owner Petra Cheng Sing has not given her consent nor did she authorize cockpit operator Rodrigo Dellomes to use her property for the operation of Rockwell Lumber Cockpit Arena.
“The supposed Affidavit of Consent dated 14 November 2014 which Mr. Dellomes submitted to your good office in support of his aforesaid request is obviously a falsified document and the signature of our client appearing thereon is apparently a forgery,” read part of Canindo’s Aug. 1 letter to Mayor Jed Patrick Mabilog.
Sing’s legal counsel said his client will be taking appropriate legal action against Dellomes.
Sing urged the city mayor and the Sangguniang Panlungsod (SP) to deny Dellomes’ request for a franchise to operate a cockpit on her property.
‘TOO LATE, GO TO COURT’
The SP approved the franchise ordinance for Rockwell Lumber and Cockpit Arena on July 18. Mabilog did not veto the ordinance but neither did he sign it. Thus after the 10-day period for the mayor to act on it lapsed on July 31, the ordinance was deemed approved.
Councilor Eduardo Peñaredondo, SP majority leader, said the city council won’t rescind the franchise ordinance.
“Indi kami ‘ya magbawi. To us, regular ang amon ginhimo and it was reasonable. Kon may reklamo sia, kadto sia ya sa korte kag ipa-nullify ang amon findings. Late na sia submit sang sulat, tapos na eh,” he said.
Councilor Mandrie Malabor, chairman of the SP committee on games, amusement and professional sports, echoed Peñaredondo’s stand.
His committee which endorsed the cockpit franchise could no longer investigate the alleged forgery of signature or falsification of the Affidavit of Consent, he also said.
“Kami ‘ya sa committee nag-rely sa documents which were all properly notarized,” said Malabor.
Sing was also invited by the committee to a public hearing on the cockpit franchise but she did not attend, Malabor added.
“Based on the principle sang regularity of function…paano na mag-fake (Affidavit of Consent) kay gin notaryohan man?” said Peñaredondo.
He said two affidavits of consent were even submitted and those were notarized by two different lawyers.
