MANILA – The Sandiganbayan suspended the arraignment of former President Benigno Aquino III and two others charged for the Mamasapano encounter due to a Supreme Court (SC) decision.
The high court issued a temporary restraining order (TRO) following a petition from the Office of the Solicitor General (OSG) to change the charge against Aquino, former Philippine National Police (PNP) chief Alan Purisima and former Special Action Force (SAF) director Getulio Napeñas from the one filed by the Office of the Ombudsman.
Each respondent is facing one count of violation of the Anti-Graft and Corrupt Practices Act and usurpation of official function but the OSG said they should be charged with reckless imprudence resulting to multiple homicide.
The Ombudsman earlier filed graft and usurpation of authority charges against Aquino, Purisima and Napeñas before the Sandiganbayan for the bungled police operation that killed 44 members of PNP-SAF.
Based on the case information, Aquino allowed Purisima to have an active role in “Oplan Exodus” despite knowing that the latter was under preventive suspension and should not have performed any official duty.
Aquino also instructed Purisima to coordinate with the Armed Forces of the Philippines and communicated exclusively with the former police chief at the height of the operations on Jan. 25, 2015./PN
