MANILA – The fatal Tanay bus crash that killed 14 college students and a bus driver could have been avoided if the Department of Transportation (DOTr) has already implemented the Speed Limiter Law, said Iloilo City’s Rep. Jerry Treñas.
On Tuesday, the congressman criticized the failure of the department to craft an Implementing Rules and Regulations for Republic Act 10916, a measure requiring all buses and trucks to install a speed limiter devices programmed at a maximum of 80 kilometers per hour.
Treñas directed the DOTr, with the Department of Science and Technology, the Department of Trade and Industry, and the Metro Manila Development Authority to complete the IRR which would include the technical specifications of the device and other terms and conditions necessary for the law’s implementation.
“Judging from the damage of the bus, it was obvious that the vehicle was over speeding. Had there been speed limiter on bus, this kind of senseless accident would not happen. This should serve as a wake-up call for the DOTr to immediately implement this Speed Limiter Law,” he said.
Road accidents in the country, according to him, are mainly caused by human error and recklessness.
Meanwhile, Treñas said the new law also aimed at improving the fuel economy and carbon footprints of vehicles.
Under the law, speed limiters will become a prerequisite for the registration of new public utility vehicles and other vehicles covered by RA 10916 at the Land Transportation Office and to obtain new franchises at the Land Transportation Franchising and Regulatory Board.
Any violation of the provisions of this Act shall face driver’s license suspension or revocation and be fined between P30,000 and P50,000, it said.
A prison penalty up to 3 years shall be imposed on anyone tampering with a speed limiter.
